1. Overview

This website and online store are operated by II Acorns & An Oak LLC, doing business as Shines Scents (“Shines Scents,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website, online store, customer accounts, content, products, and related services (collectively, the “Service”).

By accessing or using the Service, creating an account, or submitting an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy, each of which is incorporated into these Terms. If you do not agree, you should not use the Service.

Our store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer and sell our products.

2. Eligibility

You must be at least 18 years old or the age of legal majority where you live to create an account or place an order.

By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

These Terms do not prohibit a minor from lawfully using an appropriate Shines Scents product under the supervision of a parent or responsible adult. The adult purchaser is responsible for supervising such use and ensuring compliance with product instructions, hunting regulations, and applicable law.

The Service is not directed to children under 13, and children under 13 may not create accounts, place orders, or submit personal information through the Service.

3. Customer Accounts

Certain features may require a customer account. You agree to provide current, complete, and accurate information and to update that information when necessary.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Please notify us promptly if you believe that your account has been accessed or used without authorization.

We may suspend or terminate an account when reasonably necessary to protect customers, prevent fraud, comply with law, or address a violation of these Terms.

4. Products and Product Information

Shines Scents offers hunting scent-control products, wildlife attractants, field-use products, scent-free personal-care products, hunting-clothing care products, bundles, and related merchandise.

We make reasonable efforts to describe and display our products accurately. Product photographs are illustrative, and colors, packaging, labels, dimensions, and other visual details may appear differently depending on your screen, lighting, and device.

Products containing natural ingredients may have reasonable variations in appearance, color, texture, scent, composition, or consistency. Packaging, formulas, and product details may change, provided that the product remains materially consistent with its description.

The product label and instructions supplied with the product control if they differ from general information displayed on the website.

All products are subject to availability. We may limit quantities, discontinue products, or restrict sales to particular people or geographic areas when reasonably necessary and permitted by law.

Unless we agree otherwise in writing, products purchased through the online store are offered for personal use and not for resale or commercial distribution.

5. No Guarantee of Hunting Results

Wildlife behavior is unpredictable and is affected by weather, wind, terrain, hunting pressure, season, available food sources, animal movement, the user’s conduct, and many other conditions outside our control.

Shines Scents does not guarantee that any product will:

• Attract a particular animal;

• Cause wildlife to enter or remain in a particular area;

• Completely eliminate or conceal human odor;

• Prevent a hunter from being detected;

• Improve hunting success; or

• Result in an observation, encounter, recovery, or harvest.

Testimonials, photographs, stories, and descriptions of customer experiences illustrate individual results only. They do not represent a promise that another customer will experience the same result.

Nothing on the Service replaces sound judgment, hunter education, firearm or archery safety, landowner permission, or compliance with applicable hunting laws.

6. Hunting Laws and Wildlife Regulations

Hunting, baiting, supplemental feeding, placement of attractants or minerals, and the use of scent products are regulated differently among states, counties, wildlife-management areas, public lands, private lands, seasons, and species.

Some products, including natural attractant blends such as Buck Trap Powder, may be treated as bait, feed, or a wildlife attractant in certain jurisdictions. Their use may be restricted or prohibited, including in chronic wasting disease management zones or on certain public lands.

Before purchasing or using a product, you are responsible for determining whether its possession, placement, and use are lawful in the specific location, season, and manner you intend.

You agree to:

• Obtain all required hunting licenses, permits, and landowner permissions;

• Follow applicable hunting, baiting, feeding, wildlife-management, and land-use rules;

• Observe all posted restrictions and agency instructions;

• Use products only for lawful hunting, scouting, wildlife-observation, or land-management purposes; and

• Stop using or remove a product when required by law or a responsible landowner or agency.

The availability or delivery of a product to your location does not represent that the product may legally be used there. Shines Scents does not provide legal advice concerning hunting regulations.

7. Product Safety and Proper Use

You are responsible for reading and following all directions, warnings, ingredients, storage instructions, and safety information on the product label and product page.

All products must be used only for their intended purpose.

Field sprays and liquid attractants

Field sprays and attractants are not body sprays. Do not apply them directly to skin, eyes, mouth, food, or drinking water unless the product label expressly authorizes that use.

Avoid ingestion and eye contact. Wash exposed areas as appropriate and seek medical attention if a serious reaction occurs.

Wind-checking powders and dust products

Avoid deliberately inhaling powder or dust. Apply products in a manner that minimizes contact with the eyes, mouth, and respiratory system. Consider wind direction when applying a powder.

Buck Trap and other natural attractants

Use only where baiting, feeding, and wildlife attractants are lawful. Follow the storage and application directions on the label. Do not use a wildlife attractant as food for people, livestock, or domestic pets.

Scent-free shower soap

Use the shower soap only as directed for external cleansing of the body and hair. Avoid contact with the eyes. Discontinue use if irritation or an adverse reaction develops.

Statements concerning cleanliness, scent control, or odor reduction are not medical claims. The product is not intended to diagnose, treat, cure, or prevent disease.

Scent-free camo wash

Use camo wash only for laundering compatible hunting clothing and gear. Do not apply it to the body. Follow the product directions and the garment manufacturer’s washing and care instructions.

General precautions

Keep products securely stored and away from unsupervised children and domestic animals. Do not use a product if its container is damaged, altered, leaking, or appears contaminated.

Nothing in this section limits responsibility that cannot lawfully be excluded, including responsibility arising from an unsafe or defective product.

8. Orders and Acceptance

Submitting an order is an offer to purchase the products shown in the order. An automated order-confirmation message acknowledges receipt of your order but does not necessarily mean that we have accepted it.

We may accept an order by processing it for fulfillment, shipping the products, or otherwise confirming acceptance.

We may refuse or cancel an order before shipment for legitimate reasons, including:

• Product unavailability;

• Suspected fraud or unauthorized payment;

• Incorrect customer, payment, or shipping information;

• A genuine pricing or product-description error;

• Suspected unauthorized resale;

• Carrier or geographic restrictions; or

• A violation of these Terms.

If we cancel an order after collecting payment, we will refund the canceled amount to the original payment method. Your bank or payment provider may require additional time to post the refund.

You may request an order change or cancellation before fulfillment begins. We cannot guarantee that a change or cancellation will be possible once an order has entered processing or has shipped.

9. Prices, Taxes, and Payment

Prices are displayed in the currency identified at checkout and may change without notice.

A price change will not alter the price of an order we have already accepted, except when we cancel and refund an order because of a genuine pricing error.

Applicable taxes, shipping charges, and other required charges will be displayed before you complete your purchase.

You authorize us and our payment processors to charge the payment method submitted at checkout for the full order total. You represent that you are authorized to use that payment method.

Payment services may be supplied by Shopify or other third-party processors. Their handling of payment information may also be governed by their respective terms and privacy notices.

10. Promotions and Discounts

Promotional codes, discounts, and special offers are subject to their stated conditions.

Unless expressly permitted, promotions may not be:

• Combined with another offer;

• Redeemed for cash;

• Applied to a previous purchase;

• Transferred or resold; or

• Used after their expiration date.

We may reject or cancel a promotion affected by fraud, technical error, unauthorized distribution, or misuse. If canceling a promotion changes an order total after payment, we will obtain your agreement or cancel and refund the affected order.

11. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms.

Orders are ordinarily processed and shipped according to the timeframes stated in that policy. Delivery dates are estimates unless we expressly state otherwise.

Weather, carrier interruptions, address problems, high order volume, holidays, and events outside our reasonable control may affect delivery. If we cannot ship within the promised period, we will provide any notice, cancellation option, or refund required by applicable law.

You are responsible for providing a complete and accurate delivery address. Contact us promptly if you discover an error. We cannot guarantee that an address can be changed after fulfillment begins.

Risk of loss and ownership of purchased products transfer only as provided by applicable law.

12. Returns, Exchanges, and Refunds

Returns, exchanges, damaged products, and refunds are governed by our Refund Policy, which is incorporated into these Terms.

Please inspect your order promptly after delivery. Contact us if an item is missing, damaged, defective, leaking, or materially different from what you ordered.

Products that have been opened, used, contaminated, or exposed to field conditions may not be eligible for return unless they are defective or applicable law requires a remedy.

Do not mail a return to our business address without first contacting us and following the return instructions we provide. Unauthorized returns may not be accepted.

Nothing in the Refund Policy or these Terms limits any refund, replacement, warranty, or cancellation right that cannot legally be waived.

13. Wholesale and Commercial Purchases

Inquiries from retailers, outfitters, distributors, and other commercial purchasers are welcome through our Contact page.

Unless we expressly agree otherwise, orders placed through the regular online store are governed by these consumer Terms. Approved wholesale or distribution arrangements may be governed by a separate written agreement, which will control if it conflicts with these Terms.

Purchasing a product does not grant authorization to use Shines Scents trademarks, product photographs, descriptions, or marketing materials.

14. Intellectual Property

The Service and its contents—including the Shines Scents name and branding, product names, text, product descriptions, photographs, graphics, logos, designs, videos, testimonials, and website arrangement—are owned by or licensed to II Acorns & An Oak LLC and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Service for personal, lawful shopping and informational purposes.

Without our prior written permission, you may not:

• Copy, reproduce, republish, sell, or commercially exploit our content;

• Use our names, trademarks, or branding in a way that suggests sponsorship, authorization, or affiliation;

• Remove copyright, trademark, or ownership notices;

• Frame or mirror a material portion of the website; or

• Use our product photographs or descriptions to market another product or business.

15. Reviews, Testimonials, and Submissions

If you submit a review, hunting story, photograph, video, testimonial, comment, suggestion, or other material (“User Content”), you retain any ownership rights you have in that content.

You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute the User Content for operating, improving, and promoting Shines Scents. If your submission includes your name, username, image, voice, or likeness, you authorize us to display it with the submission.

You represent that:

• You own the User Content or have permission to submit it;

• It reflects your honest opinions and experiences;

• Any depicted hunting activity was conducted lawfully and safely;

• It does not violate another person’s intellectual-property, privacy, publicity, or other rights;

• It is not fraudulent, misleading, defamatory, threatening, obscene, or unlawful; and

• You will disclose any free product, discount, payment, employment, family relationship, or other material connection relevant to an endorsement.

We may moderate, decline, or remove User Content that violates these Terms. We are not obligated to publish every submission.

16. Prohibited Uses

You may not use the Service to:

• Violate any law or another person’s rights;

• Commit fraud or provide false, misleading, or unauthorized information;

• Introduce viruses, malicious code, or harmful technology;

• Interfere with the security or operation of the Service;

• Attempt to gain unauthorized access to an account or system;

• Collect another person’s information without authorization;

• Send spam, phishing messages, or deceptive communications;

• Scrape or extract content or data through unauthorized automated means;

• Impersonate another person or misrepresent an affiliation;

• Harass, threaten, discriminate against, or harm another person;

• Circumvent purchase limits or security measures;

• Use our products or content to promote unlawful hunting or wildlife activity; or

• Use the Service or its content for an unauthorized commercial purpose.

We may restrict access when reasonably necessary to investigate or address prohibited conduct.

17. Third-Party Services and Links

The Service may contain links to third-party websites or use services supplied by Shopify, payment processors, shipping carriers, analytics providers, social networks, or other service providers.

We do not control these independent third-party services and are not responsible for their content, availability, security, or practices. Your use of a third-party service may be governed by that provider’s own terms and privacy notice.

The presence of a link does not necessarily mean that Shines Scents endorses the third party or its products.

18. Privacy and Communications

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

Transactional communications concerning your account, customer-service request, or order are part of the Service. Marketing communications are governed by the choices and unsubscribe options described in our Privacy Policy and in the communication itself.

19. Availability of the Service

We may update, modify, suspend, or discontinue features of the Service. We do not guarantee that the website will always be uninterrupted, secure, or free of errors.

A modification or discontinuation will not eliminate obligations associated with orders we have already accepted, including applicable fulfillment, cancellation, and refund obligations.

20. Disclaimer of Warranties

To the maximum extent permitted by law, the website and its general informational content are provided on an “as available” basis. We do not guarantee that access will be uninterrupted or that every website error will be corrected immediately.

Except for express promises made in a product description or written warranty, and except as required by law, we do not provide additional warranties concerning the Service or products.

This section does not override:

• An express promise we make about a particular product;

• Rights provided by our Refund Policy or a written warranty;

• Implied warranties that cannot legally be excluded;

• Liability arising from an unsafe or defective product; or

• Other consumer protections that cannot legally be waived.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

21. Limitation of Liability

To the maximum extent permitted by law, II Acorns & An Oak LLC and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the Service.

To the maximum extent permitted by law, our total liability for a claim concerning a purchased product will not exceed the amount paid for the product or order giving rise to the claim.

We are not responsible for hunting accidents, unlawful hunting activity, improper product use, failure to follow product directions, or decisions made concerning wind, terrain, wildlife, stands, weapons, vehicles, or field conditions.

These limitations do not apply to liability that cannot legally be limited or excluded. This may include liability for fraud, willful misconduct, certain personal injuries, defective products, gross negligence, or violations of mandatory consumer-protection law.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless II Acorns & An Oak LLC and its officers, employees, and agents from third-party claims, damages, and reasonable expenses arising directly from:

• Your unlawful or unauthorized misuse of the Service;

• User Content you submit;

• Your infringement of another person’s rights; or

• Your material violation of these Terms.

This section does not require you to indemnify us for our negligence, misconduct, defective products, or violation of law.

23. Suspension and Termination

You may stop using the Service at any time.

We may suspend or terminate access if you materially violate these Terms, engage in fraudulent or harmful conduct, or create a security or legal risk.

Termination does not affect rights and obligations associated with an order accepted before termination. Provisions that should reasonably survive termination—including intellectual-property, payment, liability, and dispute provisions—will remain in effect.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

To the extent permitted by law, disputes relating to these Terms or the Service will be brought in the state or federal courts located in or serving Bibb County, Georgia. Each party consents to the jurisdiction of those courts.

This section does not deprive a consumer of mandatory protections provided by the law of the consumer’s place of residence or prevent a claim from being brought elsewhere when applicable law grants that right.

Before filing a formal claim, you are encouraged to contact us so that we can attempt to resolve the issue informally.

25. Changes to These Terms

We may update these Terms to reflect changes in our operations, products, Service, or applicable law. The current version will be posted on this page with an updated effective date.

Material changes will apply prospectively unless applicable law requires otherwise. When legally required, we will provide additional notice or request renewed consent.

Changes will not retroactively alter an order we have already accepted unless required by law or agreed to by both parties.

26. General Provisions

If any provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or similar business transaction, subject to applicable law.

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and any product-specific or promotional terms presented to you, constitute the agreement between you and us concerning the Service.

If specific product, promotional, wholesale, or other written terms conflict with these general Terms, the more specific terms will control for that subject.

27. Electronic Communications

You agree that order confirmations, disclosures, notices, and other transactional communications may be provided electronically, including by email or through the Service.

You are responsible for maintaining a current email address. This consent does not authorize marketing messages where separate consent is required.
